All property transactions are conducted through appropriately licensed parties.

Any transaction occurs only upon execution of binding legal documentation with the relevant parties.

4. Property-Specific Risks

  • Promotional credits are non-transferable and non-refundable
  • Promotional offers expire 30 days from issuance unless otherwise stated
  • Holding deposits, where offered, are governed by separate reservation terms
  • Payments are subject to the terms of the applicable agreement and any non-excludable consumer rights under applicable law
  • Prices are subject to change without notice

7. Intellectual Property

All content on kinnara.capital, including but not limited to text, graphics, logos, images, videos, and software, is the property of Kinnara Capital or its licensors and is protected by copyright and trademark laws. 9. KYC Requirements

For certain services, identity verification through our provider Personr.co is required. This may include:

  • Government-issued identification documents
  • Biometric verification
  • Sanctions and PEP screening

By using services requiring identity verification, you consent to the collection and processing of identity and biometric data strictly for compliance and risk management purposes in accordance with applicable law. Failure to complete required verification checks may result in account restriction or cancellation.

10. Third-Party Platforms

We are not responsible for the availability, accuracy, or conduct of third-party platforms or service providers linked to or integrated with our services, including but not limited to identity verification, payment processing, and analytics providers.

11. Data Retention

To the maximum extent permitted by law, Kinnara Capital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our platform or services. This limitation applies regardless of whether such damages are based on contract, tort, strict liability, or any other legal theory. Nothing in these Terms limits or excludes any rights or remedies that cannot be excluded under applicable consumer protection laws.

14. Indemnification

You agree to indemnify and hold harmless Kinnara Capital, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our platform, violation of these Terms, or infringement of any third-party rights.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of Hong Kong SAR. Any dispute arising from these Terms shall be finally resolved by binding arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) in Hong Kong. The courts of Hong Kong shall have exclusive jurisdiction for enforcement of any arbitral award.

To the extent permitted by applicable law, any claims must be brought within one year of the date the cause of action arose.

16. International Transfers

Your information may be transferred and processed in countries outside your residence. We use Standard Contractual Clauses and appropriate safeguards to protect your data during international transfers.

17. Modifications to Terms
